A divided U.S. Supreme Court on Tuesday sided with San Francisco in its dispute with the U.S. Environmental Protection Agency over the terms of its wastewater discharge permits, holding that the agency exceeded its authority under the federal Clean Water Act.
In a 5-4 vote, the court held that the act requires the EPA to set specific pollution limits in its wastewater discharge permits for municipal governments like San Francisco. The statute “does not authorize permit requirements conditioning compliance on receiving water quality,” the court held.
